SIXTEN REALTY DE MEXICO, S. DE R.L. DE C.V., hereinafter identified as SIXTEN REALTY, with address located at Av. Francisco Villa #1010, Local 13, colonia Jardines de Vallarta, C.P. 48328, Puerto Vallarta, Jalisco, Mexico, in accordance with articles 1, 6 and 16 of the Political Constitution of the United Mexican States and the Federal Law on Protection of Personal Data Held by Private Parties and its Regulations of Mexico, informs you  that is responsible for the use and protection of your personal data,  and in this regard issues this privacy notice of personal data held by individuals, to inform you of the terms and conditions of the processing of your personal data.

WHAT PERSONAL DATA DO WE COLLECT FROM YOU?

The information that you provide to SIXTEN REALTY or its staff, in writing, verbal, telephone or online and that we will use may include personal identification, contact, labor and patrimonial data, are mentioned in an enunciative but not limiting way below:

a) Identification Data: Name, Sex, Date of Birth, Country and / or Entity of Birth, the Federal Taxpayer Registry number, CURP, Social Security Number.

b) Contact Information: Full address of the Holders.

c) Curricular Data of Holders: Degree of studies, Profession.

d) Personal Data: Marital Status, Name of Beneficiaries and spouses, contact details and other personal references.

e) Labor, Financial, Banking, Credit and Patrimonial Data.

f) Support documents for the service.

g) Information about how you learned about SIXTEN REALTY and contact information to provide information.

To ensure that the personal data provided are correct and current, SIXTEN REALTY may collect information from other sources.

SIXTEN REALTY states that the data referred to in subparagraphs b) and d) herein, are classified as Sensitive Personal Data, with which SIXTEN REALTY must make reasonable efforts to limit the treatment thereof, so that it is the minimum necessary to comply with the purpose for which they were collected and from which the Holders grant express consent for their Personal Data Sensitive are treated.

VERACITY OF THE INFORMATION PROVIDED.

The veracity of the information provided by the Holders, to SIXTEN REALTY, is the responsibility of the person who delivered said information; Therefore, it will not be responsible for the accuracy, validity and authenticity of the personal data provided.  SIXTEN REALTY will inform the Holders of the mechanism for the rectification of the personal data that it considers pertinent, in order to keep them duly updated and which will be specified later in this notice.


FOR WHAT PURPOSES DO WE USE YOUR INFORMATION?


SIXTEN REALTY collects your personal data and will use them for the main purposes that are necessary for the service you request and that are listed below:

  • Confirm your identity
  • Comply with applicable regulatory provisions.

  • Manage the provision of real estate brokerage services.
  • Provide security and legal certainty to facts and acts.
  • Verify the information you provide to us.

Likewise, SIXTEN REALTY collects your personal data, which it will use for secondary purposes that are not necessary for the service, which allow us and facilitate us to provide you with better service, which are listed below:

In case you do not want your personal data to be processed for these additional purposes, you can present from this moment a letter at our address, stating the above. The refusal to use your personal data for these purposes may not be a reason for us to deny you the services you request or contract with us.

WHO DO WE SHARE YOUR INFORMATION WITH?


Your personal data are processed by SIXTEN REALTY personnel and may be transferred to national or foreign third parties, for the purposes mentioned in the previous point; at the request of an authority and for the fulfillment of obligations before the competent authorities.

The personal data that you provide to SIXTEN REALTY, can be compiled and fixed in databases.  SIXTEN REALTY is not responsible for the content and privacy policies of external sites of the SIXTEN REALTY portal.

We inform you that for the transfers of your information we require your consent, if you do not express your refusal for such transfers, we will understand your consent granted. In case of refusal, you can present from this moment a letter at our address, stating the above.

HOW CAN YOU LIMIT THE USE OR DISCLOSURE OF YOUR PERSONAL DATA OR REVOKE THE CONSENT GIVEN?


You can limit the use and disclosure of your personal information or revoke the consent you have given, through a written request delivered to our address.

In addition to the above, to limit the use and disclosure of your personal information, you need to carry out the following means:

Likewise, you should consider that for certain purposes, the revocation of your consent will imply that we can not continue to provide the service you requested.

HOW CAN YOU ACCESS, RECTIFY OR CANCEL YOUR PERSONAL DATA, OR OPPOSE ITS USE?

You have the right to know what personal data we have about you, what we use it for and the conditions of use we give them (Access). Likewise, it is your right to request the correction of your personal information in case it is outdated, inaccurate or incomplete (Rectification); that we delete it from our records or databases when it considers that it is not being used in accordance with the principles, duties and obligations provided for in the regulations (Cancellation); as well as oppose the use of your personal data for specific purposes (Opposition). To exercise any of the ARCO rights, you must submit the respective request in writing at our address. This request must contain at least your full name, address, documents proving your identity, clearly indicating the relationship link with SIXTEN REALTY DE MEXICO, S. DE R.L. DE C.V. and  specifying in a clear and precise manner the personal data of which you request access, rectification, updating or cancellation, the elements or documents where the personal data can act and indicating the reasons why you want to access your personal data, or the reasons why you consider that your data should be updated,  Rectified or cancelled.


From receipt, the Data Privacy area will have a period of 20 business days to respond to your request, however this period may be extended for an equal period of time, which will be notified, by the means that you have indicated for such purposes, indicating the reasons for said extension.
Likewise, we inform you that you, if applicable, can initiate the procedure for the Protection of ARCO.

Rights, before the Federal Institute of Access to Information and Protection of Personal Data (IFAI), within 15 days following the date on which SIXTEN REALTY DE MEXICO, S. DE R.L. DE C.V.  of response to your request and this is not satisfactory, or, if after the indicated term, SIXTEN REALTY DE MEXICO, S. DE R.L. DE C.V.  did not respond to your request.

SIXTEN REALTY DE MEXICO, S. DE R.L. DE C.V. continuously takes photographs and / or videos of day-to-day activities and special events in order to promote our real estate brokerage services and the properties subject to it, in publications of the website, social networks, brochures and / or advertising media. No financial compensation is granted to the person or persons who appear within the survey of these images or material.

CONSENT

The Holders, declare to have the legal capacity and representation required to acquire rights and obligations and that by signing this Notice, they have been informed of the conditions on the protection of personal data, photographs and videos, expressly expressing their consent to the Treatment thereof by the Responsible, in the manner and for the purposes mentioned in this Privacy Notice.

RETROACTIVITY

As for the Holders, of the personal data prior to the entry into force of the “Law”, they state that they have been informed through the issuance of the corresponding circular, regarding the terms and conditions of this Privacy Notice, granting them a period of ten (10) calendar days following the receipt of the aforementioned circular to express opposition to it,  otherwise, it will be understood that they tacitly consent to the Privacy Notice, in accordance with article 8 of the “Law”.

Likewise, it is made known to the Holders, that in case SIXTEN REALTY DE MEXICO, S. DE R.L. DE C.V.  intends to carry out a treatment other than the purpose described in the Privacy Notice, you must request your consent again in accordance with the provisions of article 12 of the “Law”.

CONSENT TO THE PROCESSING OF PERSONAL DATA

The owner of personal data declares to have read and agree with the terms and conditions of the Privacy Notice, knowing the purpose of the collection and processing of their personal data, as well as the procedure for the exercise of their ARCO Rights.

This privacy notice may be modified, changed or updated as a result of new legal requirements, our own needs for the products or services we offer, our privacy practices, changes in our business model, or for other reasons.
